WHEN IS A BILL OF SALE REQUIRED?
The MVA requires a bill of sale for some transactions and does not require a bill of sale for other transactions. Below we have simplified the confusing and frustrating MVA requirements for a bill of sale below.
A BILL OF SALE IS REQUIRED
- Dealership/Auction Purchase
MVA Requires Original; Signed Bill of Sale/Buyer’s Order - Private Sale for Motor Vehicle and/or Trailer 6 Years New or Newer
MVA Requires the Bill of Sale or the NADA Clean Retail Value
HB 251 and SB 125 Repealed the Notarized Bill of Sale Requirement [Oct. 1, 2026]
A BILL OF SALE IS NOT REQUIRED
- Private Sale 7 Years Old and Older
MVA Requires No Bill of Sale - Gift Transaction [Spouse to Spouse or Parent to Child]
MVA Requires No Bill of Sale
APPLYING FOR A CERTIFICATE OF TITLE
To apply for a new certificate of title for your newly purchased motor vehicle and/or trailer, you must provide the MVA with the most current certificate of title properly signed over to you by the previous owner[s]. However, if the vehicle is from a state that does not issue a certificate of title, a transferrable registration and a bill of sale must be submitted as proof of ownership when applying for a new certificate of title in Maryland.
WHAT IF THERE'S A LIEN INVOLVED?
LIEN RELEASE
If the current certificate of title to your newly purchased motor vehicle and/or trailer has a lien on it, a lien release from the lien holder [loan company] must be provided at the time of requesting a new certificate of title.
A lien release shows proof that the loan for the purchase of the motor vehicle and/or trailer has been paid off and the loan company releases the hold they had until the loan was satisfied. If the motor vehicle and/or trailer is titled in different state than Maryland, there may be a place on the title for the lienholder to sign to release the lien.
LIEN RELEASE LETTER
In lieu of a lien release, the MVA will accept an original lien release letter provided by the lienholder to release the loan from the certificate of title. The lien holder must provide an original letter on lienholder letterhead containing the items listed below to ensure that the motor vehicle and/or trailer is specifically identified and the lien can be properly released and removed from the certificate of title.
- Name of Lien Holder
- Amount of Original Loan
- Loan Account Number
- Date Lien Released
- Year, Make and Model
- Vehicle Identification Number [VIN]
- Signature of Party Releasing Lien
- Printed Name of Party Releasing Lien
- Capacity of Party Releasing Lien
- Telephone Number of Party Releasing Lien
NEW LIEN INFORMATION
If a loan was needed to buy your new or used motor vehicle and/or trailer, the lien holder [loan company] information must be placed onto the certificate of title to ensure that the lien is paid off before transferring the motor vehicle and/or trailer to a new owner. If a second lien is to be placed onto the certificate of title, the MD MVA form VR-217; Security Interest Filing must be used to add the second lien.
HOW DOES THE MARYLAND SAFETY INSPECTION WORK?
Brand new motor vehicles and/or trailers sold by an authorized dealer are not required to be safety inspected in Maryland. Your newly purchased used motor vehicle and/or trailer must be inspected at an authorized safety inspection station in Maryland. When the motor vehicle and/or trailer passes the safety inspection, the results are sent electronically to the MVA and the Maryland State Police safety enforcement website. The inspection is good for 90 days.
WHAT HAPPENS IF MOTOR VEHICLE AND/OR TRAILER FAILS SAFETY INSPECTION?
If your motor vehicle and/or trailer fails the safety inspection, you must fix the problem(s) and have the motor vehicle and/or trailer re-inspected by the same registered inspection mechanic at the same station.
- You have the option of fixing the problem yourself, having the inspection station fix the problem, or taking the vehicle to another facility for repairs.
- If the vehicle is re-inspected within 30 days after the original inspection date and you have driven it less than 1,000 miles, the inspection station will only need to inspect the defective equipment identified during the initial inspection.
- However, if a new defect is visually observed during the re-inspection, the newly discovered defect must also be repaired and re-inspected.
HOW MUCH INSURANCE DO I NEED?
You must maintain insurance on your motor vehicle with a Maryland licensed insurance provider at all times as long as tags have been issued, even if the motor vehicle is not being driven. An insurance compliance violation may result in daily fines, registration suspension, and/or tag removal. Trailers are insured under the insurance on the motor vehicle pulling it.
- Do not cancel your insurance before returning your tags. The penalties begin with an instant $200.00 fine and $7.00 a day after: not to exceed $2,500 per year.

APPLYING FOR A CERTIFICATE OF TITLE
To apply for a new certificate of title for your newly purchased motor vehicle and/or trailer, you must provide the MVA with the most current certificate of title properly signed over to you by the previous owner[s]. However, if the vehicle is from a state that does not issue a certificate of title, a transferrable registration and a bill of sale must be submitted as proof of ownership when applying for a new certificate of title in Maryland.
WHAT IF THERE IS A LIEN INVOLVED?

- Amount of Original Loan
- Loan Account Number
- Date Lien Released
- Year, Make and Model
- Vehicle Identification Number [VIN]
- Signature of Party Releasing Lien

If a loan was needed to buy your new or used motor vehicle and/or trailer, the lien holder [loan company] information must be placed onto the certificate of title to ensure that the lien is paid off before transferring the motor vehicle and/or trailer to a new owner. If a second lien is to be placed onto the certificate of title, the MD MVA form VR-217; Security Interest Filing must be used to add the second lien.

After visiting here, I cannot imagine why anyone would ever go to the MVA. Not only is there no waiting around, but the people behind the counter are actually friendly and knowledgeable. Not only was I able to return my tags, but they noted that I qualified for a partial refund on my registration and filled out the paperwork for me. You don't get this type of service at the MVA.Posted on Google![]()

This is the only Tag and Title place I would go to. It's in a nice area, the people there are quick, helpful and really seem to know what they are doing. The owner waited on me yesterday. Very pleasant and certainly is very knowledgeable. It saved me loads of time instead of being at the DMV half a day. Thank you for being professional and rapid time in accomplishing what I needed.Posted on Google![]()
